Agreement to Terms

These Terms of Service ("Terms") govern your use of the Toko Plants website, app, and the Toko plant companion device (together, the "Service"), provided by Toko Plants ("Toko," "we," "us," or "our"). By joining our waitlist, creating an account, purchasing a Toko device, or using the app, you agree to these Terms. If you do not agree, please do not use the Service.

Who Can Use Toko

Toko is designed for children to use with a parent or guardian's supervision. Accounts must be created and managed by a parent or guardian who is at least 18 years old. By creating an account, you confirm that you meet this requirement and that you are responsible for your child's use of the Service.

Waitlist and Orders

Joining our waitlist reserves your place to be notified when Toko becomes available; it is not a purchase and does not guarantee product availability. When you place an order, you agree to provide accurate payment and shipping information. We will confirm order details, including price and estimated delivery, before or at the time of purchase. Prices and availability may change without notice.

Using the App and Device

The Toko app and soil sensor are intended to help you and your child care for a real plant. You agree to use the Service only for its intended purpose, to keep your account credentials secure, and not to tamper with, reverse-engineer, or misuse the device or app in a way that could harm the Service or other users.

Intellectual Property

The Toko name, logo, app, device design, and related content are owned by Toko Plants and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or content beyond what is needed to use the Service as intended.

Product Warranty

We want your Toko device to work well. If your device has a manufacturing defect, contact us and we will work with you on a repair, replacement, or refund consistent with applicable consumer protection law. Beyond that, the Service is provided "as is," and we do not guarantee it will be uninterrupted or error-free.

Limitation of Liability

To the extent permitted by law, Toko Plants is not liable for indirect, incidental, or consequential damages arising from your use of the Service. Nothing in these Terms limits liability where the law does not allow it to be limited.

Changes to the Service or These Terms

We may update the app, device features, or these Terms from time to time. If we make material changes to these Terms, we will post the updated version here with a new "last updated" date. Continued use of the Service after changes take effect means you accept the updated Terms.

Termination

You may stop using the Service and close your account at any time by contacting us. We may suspend or end access to the Service if these Terms are violated or if needed to protect the security of the Service.

Governing Law

These Terms are governed by the laws of the jurisdiction in which Toko Plants operates, without regard to conflict-of-law principles.
